Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ServiceWurk platform and website at servicewurk.com (the “Service”), provided by ServiceWurk (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ServiceWurk is software that helps service businesses manage clients, quotes, scheduling, jobs, invoicing, payments, a marketing website, and related tools. We may add, change, or remove features over time.
2. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorized use.
3. Subscription, trial, and billing
- The Service is offered on a subscription basis at the price shown at signup (currently $99/month), following any free-trial period we offer.
- Subscriptions renew automatically each billing cycle until cancelled. You can cancel at any time; cancellation stops future charges and takes effect at the end of the current cycle.
- Fees are billed through our payment processor. Except where required by law, fees are non-refundable.
- We may change pricing with reasonable notice; changes apply to the next billing cycle.
4. Your content and data
You retain ownership of the information and content you enter into the Service (“Your Content”), including your client records, quotes, invoices, and website content. You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the rights to use it, including any personal information about your own clients.
5. Payments to you from your clients
When you connect your own payment accounts (such as Stripe, PayPal, Venmo, Cash App, or Zelle) to accept payments from your clients, those payments flow directly to your accounts and are processed by those providers under their terms. ServiceWurk is not a party to, and does not hold, transmit, or take responsibility for, those funds.
6. Acceptable use
You agree not to misuse the Service, including by: violating any law; sending spam or unlawful messages; infringing others’ rights; uploading malicious code; attempting to gain unauthorized access; or using the Service to harass or defraud. You are responsible for complying with laws that apply to your communications with your clients, including consent and anti-spam requirements.
7. Third-party services
The Service integrates with third-party providers (for example, payment, email, and mapping services). Your use of those integrations is subject to the third parties’ own terms, and we are not responsible for their acts or omissions.
8. Intellectual property
The Service, including its software, design, templates, and the ServiceWurk name and logo, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our branding except as needed to use the Service.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, ServiceWurk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
11. Indemnification
You agree to indemnify and hold ServiceWurk harmless from claims, losses, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or others. On termination, your right to use the Service ends; we will make Your Content available for export for a reasonable period where practicable.
13. Governing law
These Terms are governed by the laws of the United States and the state in which ServiceWurk operates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law provides otherwise.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
